GENERAL TERMS AND CONDITIONS
OF VR Wax and Sugar GmbH (“Flower Me Up”) FOR BUSINESS WITH CONSUMERS
01. TERMS AND CONDITIONS; CONTRACTUAL PARTNER
The following General Terms and Conditions (hereinafter “GTC”) apply to all contracts concerning the purchase of goods in the online shop: Flower Me Up, Managing Director Viktoria Reznikova, Kantstraße 125, 10625 Berlin, e.g. available at https://www.flowermeup.de – by the customer (the ‘client’ Flower Me Up and the customer are collectively referred to as the ‘parties’). Divergent conditions of the customer do not factor into the existing contract between the parties, even if Flower Me Up does not expressly contradict their validity. Only Flower Me Up and the ordering customer are contractual partners within the framework of the agreement of the aforementioned contract.
02. ORDER BY THE CUSTOMER
2.1 All customer orders are subject to acceptance by Flower Me Up and the availability of the goods. When placing an order, the customer guarantees the correctness and completeness of all information provided. Furthermore, the customer confirms that he is an authorized user of the credit card or debit card or any other means of payment used for the order.
2.2 Only persons who have a residential address within the European Union (EU) and for whom the order is made, neither for their commercial nor for their self-employed professional activity, and likewise no order may be placed for them by a third party. Those who are defined as entrepreneurs by the terms of § 14 BGB are not entitled to place orders. We expressly point out that we do not accept invoices as defined by § 14 UStG (Value Added Tax Act).
03 CONCLUSION OF CONTRACT
3.1 The presentation of the products in the online shop does not represent a legally binding offer, but only non-binding product prices. By ordering goods, the customer agrees to a binding offer to conclude a sales contract. After placing the order, the customer receives an e-mail confirming receipt of the order (hereinafter referred to as “order confirmation”). This order confirmation does not constitute an acceptance of the offer and therefore does not constitute a contract. A sales contract between Flower Me Up and the customer is only concluded by a further express order confirmation (acceptance of offer by Flower Me Up after checking the customer data (creditworthiness and identity check and availability of the goods) or by dispatch of the goods.
3.2 The delivery of goods shall only take place in normal household quantities.

4.1 Flower Me Up delivers only after receipt of the purchase price plus any shipping costs.
05. PRICES AND TERMS OF PAYMENT
5.1 The prices stated in the online shop are final prices including statutory VAT plus any shipping costs incurred. Within the online-order process, the customer receives an overview with information about the total price of the order before sending the order.
5.2 The customer can make the payment by credit card & PayPal.
5.3 Payment of the purchase price is due immediately upon conclusion of the contract.
06. TRANSPORT DAMAGE
Should the flowers or the box arrive damaged, please inform us immediately and send us two photos (1. of the damage and 2. of the corresponding box including contents) to the following e-mail address: firstname.lastname@example.org
All complaints must be made within one hour of the confirmation of acceptance of the shipment. Complaints will not be admissible after this deadline.
07. RETENTION OF TITLE
The goods remain the property of Flower Me Up until the purchase price has been paid in full.
The warranty is governed by the statutory provisions.
The goods offered in the online shop are shown on the Internet page in the form of exemplary illustrations. Minor deviations between representation and actual condition do not constitute a defect in the ordered goods. In any case, the product description alone is enough to determine the quality of the products offered. We would like to point out that the products presented in the online shop may no longer be available or available at the time of the customer’s visit to the website or that the corresponding prices may have changed.
09.1 In the case of intent or gross negligence, Flower Me Up is liable without limitation for all foreseeable damages caused by such intent or gross negligence.
